Organiser Information and Scope of the General Terms and Conditions The organiser of the package holidays offered is ABARAKA VIATGES RESPONSABLES, with NRT F-141292-X and registered office at C/Hort de Godí no. 11, AD200 Encamp (Principality of Andorra). These General Terms and Conditions form an integral part of ALL package holiday contracts entered into by the Organiser and are binding on both parties, together with the specific conditions agreed upon in the CONTRACT and, in particular, those established in the Programme–Quotation and those included in the travel documentation provided to the Traveller. 2. Contracting Process 2.1 Pre-contractual Information Once the traveller requests the booking of a package holiday and prior to its formalisation, ABARAKA VIATGES RESPONSABLES shall prepare a Programme–Quotation containing a description of the main characteristics of the trip. Likewise, the traveller shall be provided with general information regarding passport and visa requirements, as well as any health formalities necessary to undertake the trip and stay at the destination. The traveller shall also be advised on taking out travel assistance insurance covering repatriation expenses in the event of accident, illness, or death. 2.2 Programme–Quotation and Contract The Programme–Quotation shall include the main characteristics of the trip and the price, which shall also be detailed in the Contract, together with the payment terms and methods. The prepared Programme–Quotation shall be considered binding on the Organiser, except in any of the following circumstances: If changes to such information have been clearly communicated, in a comprehensible manner and in writing, to the consumer prior to the final confirmation of the booking. If, after confirmation of the booking, modifications occur and these are accepted by the traveller in accordance with the provisions set out in these General Terms and Conditions. Before concluding the package travel contract, the Organiser shall communicate to the traveller, in a clear, comprehensible, and prominent manner and on an appropriate medium, any changes to the pre-contractual information. 2.3 Booking Request Based on the prepared Programme–Quotation, the Traveller shall submit to the Organiser a firm booking request for the Package Holiday. Following this request, the Organiser undertakes to carry out the necessary arrangements with its suppliers in order to process the booking. At the time of the booking request, the Traveller shall pay a deposit corresponding to 30% of the total trip amount, unless there are fewer than 30 days remaining before the departure date, in which case an alternative payment arrangement shall be agreed with the client. The amount of the deposit shall be detailed in a Proforma Invoice, simultaneously informing the Traveller of the proposed payment schedule. If the booking is confirmed, the amount paid shall be deducted from the total trip price. Once the deposit has been paid, the Organiser shall proceed to confirm the booking with its suppliers and shall inform the Traveller of any incident or modification affecting the planned trip, proposing alternative services where appropriate. Should the Traveller reject the proposed alternative services, the full amount paid shall be refunded, thereby terminating the initial contractual negotiations between both parties without either party being entitled to claim compensation. 2.4 Booking Confirmation Once the final booking process with the suppliers has been completed, the booking shall be confirmed with the Traveller, at which point the package travel contract shall become binding on both parties. If the consumer withdraws the booking request prior to the final confirmation, the deposited amount shall be refunded, less any reasonable management fees incurred. 2.5 Signature of the Contract Once the booking has been confirmed, the Package Travel Contract shall be signed immediately. The present General Terms and Conditions, the prepared Programme–Quotation, and the standardised information for package travel contracts shall form an integral part thereof. Once the booking confirmation deposit has been paid and the contract has been signed by the client, the Organiser shall also sign the contract and issue the corresponding invoice for the amount paid by the Traveller. 2.6 Final Payment of Outstanding Amounts and Delivery of Travel Documents The available payment methods are: PAYMENT BY BIZUM: The platform will request the amount, and the customer must authorise the payment, which will be automatically debited from the linked current account. STANDARD BANK TRANSFER: Once the booking has been made, the client must complete payment within the following 24 hours for the accepted amount. The transfer reference must include the booking reference or concept number provided by the Organiser at the end of the booking process. Proof of transfer must be sent to the following email address: reserves@abarakaviatges.com. Requesting a booking implies the client’s commitment to authorise the charge for the full amount of the contracted product, service, or package holiday. The Traveller shall pay any outstanding amounts within the deadlines established in the signed contract. Airline tickets must be paid for at the time the booking is formalised. This date is determined by the different airlines and shall be communicated to the client at the time the service is confirmed. Once the final payment has been made, in accordance with the agreed payment schedule, which must take place no later than 30 days prior to the departure date, all relevant travel
